SERIAL BOND RESOLUTION DATED JUNE 14, 2021
A RESOLUTION AUTHORIZING THE ISSUANCE OF $525,000 SERIAL BONDS OF THE QUEENSBURY UNION FREE SCHOOL DISTRICT, WARREN COUNTY, NEW YORK FOR THE PURCHASE OF FOUR (4) 72 PASSENGER SCHOOL BUSES
WHEREAS, on May 18, 2021 the qualified voters of the Queensbury Union Free School District authorized the purchase of four (4) 72 passenger school buses at a total maximum cost of $525,00, which said sum or so much thereof as may be necessary is to be paid from the proceeds of the obligations issued pursuant to the Local Finance Law, and
WHEREAS, it is the desire to provide for the financing thereof;
NOW, THEREFORE, BE IT RESOLVED:
- The specific object or purpose for which obligations are to be issued pursuant to this resolution is for the purchase of four (4) 72 passenger school buses.
- The current maximum cost of the aforesaid specific object or purpose is $525,000, and the plan for the financing thereof is the issuance of $525,000 serial bonds of said School District, hereby authorized to be issued pursuant to the Local Finance Law. Such bonds are to be payable from amounts which shall annually be levied on all the taxable real property in said School District, and the faith and credit of said Queensbury Union Free School District, Warren County, New York, are hereby pledged for the payment of said bonds and the interest thereon.
- It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is five (5) years, pursuant to subdivision 29 of Paragraph a of Section 11.00 of the Local Finance Law.
- Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bonds or bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the President of the Board of Education, the chief fiscal officer, or in her absence, the Vice-President of the Board of Education, who is the substituted chief fiscal officer. Such bonds or notes shall be of such terms, form and contents, and shall be sold in such manner, as may be determined by said President or Vice-President of the Board of Education, pursuant to and consistent with the provisions of the Local Finance Law.
- The validity of such bonds and bond anticipation notes may be contested only if:
- Such obligations are authorized for an object or purpose for which said School District is not authorized to spend money; or
- The provisions of law which should be complied with as of the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty (20) days after the date of such publication; or
- Such obligations are authorized in violation of the provisions of the Constitution.
- This resolution shall take effect immediately and shall be published in full in the Post Star which is hereby designated as the official newspaper of said School District for such purpose, together with a notice of the School District Clerk substantially in the form provided in Section 81.00 of the Local Finance Law.

RESOLVED, that the Board of Education of Queensbury Union Free School District hereby authorizes the funding of the District’s approved reserves with the excess of 4% from unassigned fund balance at June 30, 2021 after the designated amount for tax reduction has been set. The allocation of such fund balance will be determined subsequent to June 30, 2021 and prior to setting the tax levy.

WHEREAS, the Board of Education desires to adopt the New York State
Deferred Compensation Plan for Queensbury Union Free School District employees (the “Plan”) for voluntary participation of all eligible employees; and
WHEREAS, the Queensbury Union Free School District is a local public employer eligible to adopt the Plan pursuant to Section 5 of the State Finance Law; and
WHEREAS, the Board of Education has reviewed the Plan established in accordance with Section 457 of the Internal Revenue Code and Section 5 of the State Finance Law of the State of New York; and
WHEREAS, the purpose of the Plan is to provide eligible employees with a convenient and tax-favored method of saving on a regular and long-term basis and thereby provide for their retirement;
NOW, THEREFORE, it is hereby:
RESOLVED, that the Board of Education of the Queensbury Union Free School District hereby adopts the Plan for the voluntary participation of all eligible employees; and it is further
RESOLVED, that the appropriate officials of the Queensbury Union Free School District, including its President, Clerk, Superintendent, and Assistant Superintendent for Business are hereby authorized to take such actions and enter such agreements as are required or necessary for the adoption, implementation, and maintenance of the Plan; and it is further
RESOLVED, that the Administrative Services Agency of the Plan is hereby authorized to file copies of these resolutions and other required documents with the President of the State of New York Civil Service Commission.

WHEREAS, the Town of Queensbury is seeking to extend the Town’s sewer system to the westside of the Aviation Road overpass in the Town of Queensbury; and
WHEREAS, the Town of Queensbury is applying for a grant to offset some of the expenses related to the sewer system expansion; and
WHEREAS, in order to complete the sewer system expansion and obtain the grant, the Town will need an easement from the Queensbury Union Free School District in order to allow the sewer pipe in the sewer system expansion to be placed under School District property;
NOW, THEREFORE, IT IS HEREBY
RESOLVED, that the Board of Education of the Queensbury Union Free School District hereby confirms that the Queensbury Union Free School District supports the Town’s expansion of the sewer system; and it is further
RESOLVED, that the Board of Education of the Queensbury Union Free School District shall approve an easement to the Town of Queensbury, on mutually agreeable terms and subject to the applicable Education Law requirements, which easement is necessary for the sewer system expansion to be completed by placing sewer pipe under School District property located along the School District’s easterly boundary.
